關(guān)于印發(fā)《國(guó)內(nèi)快遞服務(wù)合同》示范文本的通知
各省、自治區(qū)、直轄市郵政管理局、工商行政管理局：
為規(guī)范快遞服務(wù)，維護(hù)消費(fèi)者的合法權(quán)益，國(guó)家郵政局和國(guó)家工商行政管理總局組織制訂了《國(guó)內(nèi)快遞服務(wù)合同》示范文本?，F(xiàn)予印發(fā)，自XX年10月1日起施行。請(qǐng)各?。▍^(qū)、市）郵政管理局、工商行政管理局指導(dǎo)快遞企業(yè)做好施行工作，要密切注意施行過(guò)程中的情況，出現(xiàn)問(wèn)題及時(shí)向國(guó)家郵政局、國(guó)家工商行政管理總局報(bào)告。

國(guó)內(nèi)快遞服務(wù)協(xié)議
1.快遞詳情單是本協(xié)議的組成部分。本協(xié)議自寄件人、快遞服務(wù)組織收寄人員在快遞詳情單上簽字或蓋章后成立。
2.快遞服務(wù)組織依法收寄快件，對(duì)信件以外的快件按照國(guó)家有關(guān)規(guī)定當(dāng)場(chǎng)驗(yàn)視，對(duì)禁寄物品和拒絕驗(yàn)視的物品不予收寄。向寄件人提供自快件交寄之日起一年內(nèi)的查詢服務(wù)。
3.寄件人不得交寄國(guó)家禁止寄遞的物品，不得隱瞞交寄快件的內(nèi)件狀況，應(yīng)當(dāng)依照相關(guān)規(guī)定出示有效證件，準(zhǔn)確、工整地填寫快遞詳情單。
4.快遞服務(wù)組織在服務(wù)過(guò)程中造成快件延誤、毀損、滅失的，應(yīng)當(dāng)承擔(dān)賠償責(zé)任。雙方?jīng)]有約定賠償標(biāo)準(zhǔn)的，可按照相關(guān)法律規(guī)定執(zhí)行。既無(wú)約定也無(wú)相關(guān)法律規(guī)定的，從快遞服務(wù)標(biāo)準(zhǔn)規(guī)定?？爝f服務(wù)組織有償代為封裝的，承擔(dān)因封裝不善造成的延誤、毀損、滅失責(zé)任。
5.寄件人違規(guī)交寄或填單有誤，造成快件延誤、無(wú)法送達(dá)或無(wú)法退還，或因封裝不善造成快件延誤、毀損、滅失的，由寄件人承擔(dān)責(zé)任。
6.快遞服務(wù)組織可以與寄件人約定送達(dá)時(shí)間，沒(méi)有約定的從快遞服務(wù)標(biāo)準(zhǔn)規(guī)定。快遞服務(wù)組織將快件送達(dá)收件人，登記收件人有效證件號(hào)，經(jīng)收件人簽章，視為送達(dá)。收件人是單位的，由單位收件人員簽章，加蓋該單位收發(fā)章，視為送達(dá)。
7.免責(zé)事由從法律法規(guī)規(guī)定，未盡事宜可由協(xié)議雙方另行商定。
domestic express service agreement
1. the express waybill constitutes part of this agreement which shall come into force upon the signature or seal by both the sender and collector on the waybill.
2. all collection and delivery activities shall be governed by law. the express service provider would examine right on the spot all items except letters according to relevant rules and regulations, and shall not accept prohibited or unexamined items. tracking and tracing service shall be available within one year as of the collection date.  
3. the sender shall not consign any prohibited articles, or conceal any information concerning the articles contained in the items to be delivered, shall provide valid certificates as stipulated and fill out the express waybill accurately and carefully.
4. the express service provider shall assume the liabilities of compensation for any delay or damage to or loss of items incurred in the process of the service. relevant rules or regulations shall apply in case of unavailability of agreement on compensation standard, and the express service standard in case of absence of both agreement and regulations. the express service provider shall bear the responsibility for any delay or damage to or loss of items arising from pre-paid but improper packaging by the express service provider.
5. the sender shall take the responsibility for any delay or failure in delivery or return arising from improper consignment or inaccurate information provided, or any delay or damage to or loss of items incurred in connection with inappropriate packaging by the sender.
6. the express service provider may agree on a delivery time with the sender, and the express service standard shall apply in case no such agreement is made. the express item shall be deemed delivered upon recording of receiver’s id number, signature or seal by the receiver, and/or the company seal if applicable after the express service provider sends it to the addressee.
7. relevant rules and regulations shall apply to disclaimer subjects. and matters not mentioned herein may be negotiated later by the two parties to this agreement.
